UncategorizedHow to Move from Student Residence to a Work Permit in Türkiye

Does student residence authorise employment?

A student residence permit alone does not authorise work in Türkiye. A foreign student must obtain the work permit or valid exemption required for the activity and status. For employment with an employer, that employer generally submits the application through e-İzin. The commonly described “transition” is not a simple conversion of one card into another: work authorisation and lawful residence must be planned together. (Ministry of Labour, work permit questions)

Start by establishing whether studies continue, the educational level, the residence permit’s validity and the proposed work. A current undergraduate is not in the same position as a graduate. Postgraduate rules cannot simply be applied to an associate-degree student. Identify these distinctions before signing a contract and setting a starting date.

When may associate-degree and undergraduate students work?

Foreign students enrolled in formal associate-degree or undergraduate programmes at a Turkish higher education institution may work part-time after completing their first year of study. This is not merely twelve months since entering Türkiye. University and Higher Education Council records must establish the educational position. Preparatory study, frozen registration or transfer from another programme requires clarification against the individual record. (Ministry, foreign student assessment criteria, section B/9)

A full-time job does not meet the part-time requirement merely because its paperwork uses another label. The contractual schedule, actual duties and class timetable should agree. Rather than inventing a single fixed weekly-hour limit for all students, examine the part-time arrangement together with applicable labour rules. Discuss shifts and academic workload before approval.

What differs for master’s and doctoral students?

Applications for foreign students enrolled and studying in formal postgraduate programmes are not subject to the first-year and part-time restrictions specified for associate and undergraduate study. This does not eliminate the permit requirement. Enrolment in a master’s programme neither permits immediate work anywhere nor guarantees approval. Employer, occupation, wages and professional prior authorisation remain relevant.

A doctoral student’s academic appointment and engineering employment in a private company may require different documentation. Academic work may involve Higher Education Council prior permission, while healthcare may require the relevant Ministry’s permission. A student certificate does not replace professional authorisation. Current formal enrolment must be shown through present records, independently of a future diploma.

Why check student records and scholarships?

The Ministry explains that Higher Education Council records determine student status. Resolve discrepancies between a university certificate and the system through the university. An old admission letter may not establish current active enrolment. Match the student number, programme, year, registration date and expected graduation to the correct person.

For Türkiye Scholarships students, the opinion of the Presidency for Turks Abroad and Related Communities is sought. For beneficiaries of the Higher Education Council scholarship programme, its opinion is required during study and after graduation. Check scholarship agreements and notification duties. Scholarship continuation and permit approval can involve different institutions; telling the employer alone does not necessarily fulfil scholarship obligations.

How is residence checked for a domestic application?

The Ministry’s general explanation allows domestic applications for foreigners in Türkiye with a residence permit issued for at least six months and still valid on the application date. This should not be restated as necessarily requiring six months remaining or six months already spent waiting. The original duration and present validity are separate checks, alongside any special route. (Ministry, work permit application types)

If studies have ended, a future expiry date printed on the card may not be enough. Examine the legal basis with graduation or deregistration dates. Being able to apply does not guarantee approval. Where domestic conditions are absent, assess the consular route. An employer’s online draft does not repair the foreigner’s residence position.

What should the offer and contract clarify?

Identify the correct employer, workplace, duties, pay and working pattern. Describing the job as another occupation in the application undermines consistency. Plan the starting date subject to the required authorisation. Probation is not an exception to the permit requirement; unpaid “trial work” can also create problems.

Clarify gross or net pay, the part-time arrangement and compatibility with classes. Labour rights and permit conditions are distinct but affect the same relationship. The page on labour law provides context for pay, overtime and termination. Permit approval does not automatically make every contract term lawful.

Documents prepared by the student and employer

The general file includes a passport, photograph, contract and, depending on the role, diploma or qualification evidence. Prepare current enrolment and educational records for student-specific review. Employer documents may include trade registration, tax and financial information, workplace records and activity licences. Requirements vary with occupation and route, so a general list is not exhaustive. (Ministry, work permit application documents)

Explain different name spellings and preserve the connection between a renewed passport and old permit records. Where translation or authentication is required, use the procedure appropriate to the document. An additional item requested in one case should not be presented as compulsory for every student.

How does the e-İzin application proceed?

The authorised employer user selects the proper route, enters the foreigner and workplace information and uploads documents. Prepare electronic signature, representation and workplace registration in advance. The student should check personal and educational data: employer submission does not make inaccuracies unimportant. A draft is different from a signed and submitted application.

Record the submission number and date. Follow any request for missing material, its deadline and delivery method. Obtain basic case information instead of relying solely on verbal reports from human resources. Distinguish technical warnings from an administrative refusal. Use official guidance for changing system screens rather than treating a fixed screen sequence as guaranteed. (Ministry, domestic and overseas procedures)

What obstacles concern the employer or proposed role?

A suitable offer alone is insufficient. Employment, financial capacity and wage criteria, together with sector-specific exceptions, must be considered. Some exceptions concern particular people or roles; being a university student does not grant them all. Evidence must support any claimed exception. Recheck current criteria at filing.

Special negative assessment rules concern student applications for inappropriate entertainment-sector roles and domestic service. The city of study is among the factors considered for associate and undergraduate students. Occupations reserved to Turkish citizens and those requiring prior professional permission are separate issues. The assumption that a student may perform any job overlooks these controls.

Residence and work while the application is pending

Submission does not authorise starting work while approval is pending. Social security registration or a signed contract does not replace permission. Track lawful residence under the student permit or another valid basis separately. Residence renewal is a different application; an appointment for one procedure does not complete the other.

Waiting only for the work decision is risky as residence expiry approaches. If studies continue, assess the appropriate residence step in time; if registration ends, identify a new lawful purpose. The residence permit procedures article offers general context. Acceptance of an application, issue of an application document and final approval are different stages. Read the rights granted by the actual document held.

Do studies continue after work permit approval?

Article 19 of Law No. 6735 expressly states that a foreign student’s work permit does not terminate a valid student residence permit or the rights it provides. A general claim that the student permit must first be cancelled and converted is therefore incorrect. The student’s existing conditions may continue alongside a separate work authorisation. (Parliament, Law No. 6735, Article 19)

A valid work permit generally substitutes for residence permission. Continuing education depends separately on university conditions. Work approval should not be treated as automatic deregistration from university. Confirm how records are maintained and do not request closure of existing residence before approval. (Migration Presidency, implementing regulation, Articles 25, 26 and 38)

After approval, check commencement, employer and duties, fees and document obligations, social security and actual starting arrangements. An employer change does not transfer the old permit automatically; see the foreign employee’s employer-change process. A change of programme also calls for reassessment of compatibility between study and work.

Graduation and deregistration change the plan

Graduation matters because the study basis ends. Do not assume no action is needed until the printed card expiry. The regulation includes a ten-day rule for applying for residence appropriate to a new purpose after the former basis ends. This differs from the six-month eligibility window for a particular graduate residence category. It does not create six months of unauthorised stay.

Law No. 6458 allows eligible graduates of Turkish higher education applying within six months of graduation to be considered for a one-time short-term residence permit of up to one year. This is not a work permit. Compare graduation, offer and application dates on one calendar. Deregistration or inability to continue studies also requires prompt assessment of another lawful basis. (Law No. 6458, Articles 29 and 31)

Internships, remote work and refusal

Mandatory internships, exchange programmes, university activities and ordinary paid employment may follow different rules. Where an exemption is possible, confirm the category, conditions and documentation. Calling work an internship does not create exemption. Nor does payment from abroad alone establish that remote activity needs no permission; examine the actual work and status.

On refusal, obtain reasons and service records, distinguish the Ministry’s thirty-day objection route from judicial review, and check residence independently. Refusal of work and cancellation of student residence are not the same act. If an issued permit is later cancelled, see steps following work permit cancellation. Attorney Esra Aslan can assist with matching educational records to an offer and preparing a response to the specific reasons.

Planning the university and employment calendars together

Keep four dates separate: residence expiry, actual end of student status, submission by the employer and the date authorised work can begin. A later date in one category does not extend another. A contract starting next month does not preserve residence ending this week. Do not promise a fixed approval date when scheduling employment. A common calendar for the student, university and employer reduces misunderstandings.

In a hypothetical example, a second-year undergraduate receives an offer for certain weekdays. First document completion of year one, agree a compatible part-time schedule and examine the employer’s criteria. The student continues studying and maintains lawful residence while waiting. If the job actually requires full-time shifts, relabelling the contract is insufficient; the real arrangement must change.

In another hypothetical example, a master’s student learns that graduation was recorded after submitting a thesis. Check when the study basis ended, whether a work permit exists and whether a new residence step is needed. Thesis submission, the examination decision and official graduation can carry different dates. Obtain the authoritative university record rather than calculating from an assumption. These are not actual client cases.

The student should retain records identifying the authorised employer and role. Clarify responsibility for notifications after an employer change, job ending or suspension of study. A consultant does not remove student and employer duties. Use formal authorisation instead of sharing personal passwords or electronic signatures, and retain accessible submission and notification records.

This is general information. Programme type, scholarship, occupation and permit records need individual assessment.

Frequently Asked Questions

Can I work weekends with my student card?

The card alone is insufficient. The day of the week does not remove permit requirements.

Does the first-year restriction apply to master’s students?

It does not apply to formal postgraduate students in the same way as to associate and undergraduate students; permission is still required.

Must six months remain on my residence permit?

That is not the general wording. Check a permit issued for at least six months, current validity and special conditions.

Does preparatory study count as the first year?

Confirm against the individual educational record rather than time spent in Türkiye alone.

May I start trial work once the employer applies?

Application is not authorisation. Do not begin work requiring permission under a trial label.

Should I disclose my scholarship?

Yes. Accurate programme information is needed, including special opinion procedures for Türkiye Scholarships and Council scholarships.

May I remain six months without a permit after graduation?

No. The graduate application condition is not a general six-month right to unauthorised stay.

Does work approval automatically close university registration?

No. Study conditions and record updates are assessed separately.

Is every internship exempt?

No. Verify the type, programme and exemption conditions and obtain documentation where required.

Does work refusal automatically cancel student residence?

These are distinct decisions. The student permit’s own conditions and validity require separate review.
