UncategorizedRejection of International Protection: Objections and Court Proceedings

What should you do first after a rejection?

A rejection of an international protection application in Turkey can be challenged through an administrative objection or an annulment action, depending on the type of decision. For a rejection under the regular procedure, the time limit is 10 days for an objection to the Commission and 30 days for an action before the administrative court. Inadmissibility and accelerated procedure decisions are subject to a 15-day period for a direct court challenge. These periods are linked to notification of the decision. The first step is therefore to identify the document’s precise nature, legal basis and notification date. Different negative decisions do not all follow the same procedure.

Do not calculate a deadline solely from information received by telephone, a change in an identity record or a relative’s interpretation. Review every page of the decision together with the notification record and any record of information provided through an interpreter. Article 80 of Law No. 6458 sets out the principal remedies available to the applicant, their legal representative or lawyer. (Law on Foreigners and International Protection No. 6458)

It is useful to open a file on the day the rejection is received, keep photographs of the papers and record each required step with its own deadline. Do not assume that collecting evidence, arranging translation or waiting for a lawyer automatically suspends the time limit. Protecting the deadline and preparing the substance of the challenge should proceed together.

A regular rejection, inadmissibility and deemed withdrawal are different

A regular rejection is a negative decision following assessment of the asserted need for protection. The assessment concerns persecution or serious harm and the conditions of the relevant protection status, rather than simply a wish to work or achieve better living conditions in Turkey. An effective response requires understanding which facts the administration accepted, which it considered unreliable and how it used country information.

Inadmissibility is a separate type of decision under Article 72. It may arise where the same application is renewed without different grounds, or in connection with a first country of asylum or safe third country assessment. Merely describing danger in the country of origin may not be enough: the response should also explain why the particular inadmissibility ground cannot properly be applied to the individual.

A decision treating an application as withdrawn concerns obligations during the procedure, for example unjustified failures to report. Hospital records, attempts to report or permission documents may then become particularly important. A petition addressing only the issues involved in a regular rejection is unsuitable. Cancellation of temporary protection registration and refusal of a residence permit are also distinct from the international protection rejection procedure discussed here. The legal nature of the document matters more than a casual description of its title.

How do you check notification and calculate time limits?

The date a decision was issued may differ from the date it was notified. Looking only at the date at the top of the decision can therefore be misleading. Who received notification, by what method and on which day? Was it served on a lawyer or legal representative? Is there an electronic notification record? The answers determine the relevant starting point. Keep the signed notification document and delivery records.

The general administrative litigation rule is that a period begins on the day following notification. Holidays are included, with a separate rule where the last day falls on a holiday. This should not be interpreted as meaning that every special time limit is extended by the judicial recess. Check the actual calendar together with the applicable special provision. (Administrative Judicial Procedure Law No. 2577, Article 8)

It is also important that a person who does not speak Turkish can understand the decision’s consequences and available remedies. If information or interpretation was inadequate, record exactly what was not understood and how that affected the challenge. Rather than doing nothing because of a suspected defect, obtain legal assessment with the earliest potentially applicable deadline in mind.

Which remedy applies to which decision?

The table separates remedies that are frequently confused. The periods shown are filing periods linked to notification, not the time taken to prepare the decision or a guaranteed date for completion of litigation. If the type of decision is uncertain, do not simply rely on the longest period in the table.

Type of decisionCompetent bodyFiling period
Regular procedure rejectionInternational Protection Evaluation Commission or competent administrative court10 days for the Commission; 30 days for court
Inadmissible application, Article 72Directly to the competent administrative court15 days
Accelerated procedure, Article 79Directly to the competent administrative court15 days
Application deemed withdrawnCommission or competent administrative court10 days for the Commission; 30 days for court
A separate removal decisionA separate challenge before the competent administrative court7 days; do not confuse this with the protection case deadline

Administrative detention is challenged before the criminal judgeship of peace; that procedure does not replace an annulment action against rejection of protection. The Presidency of Migration Management also specifically explains the 15-day judicial remedy for accelerated procedure and inadmissibility decisions. (Presidency of Migration Management, International Protection Questions)

Preparing an objection to the Commission and understanding its effect

An objection to the International Protection Evaluation Commission against a regular rejection should identify the aspects of the decision that require reconsideration. Include the decision and notification details, application number, a short chronology and supporting documents. The provincial directorate transmits the objection and documents to the Commission. Obtain a receipt or registration record for the papers submitted so that the application can be tracked.

The Commission may examine procedural and substantive issues, request information and speak with the person or their representative. It can reject the objection or ask the administration to reconsider its decision. The implementing regulation provides a 15-day decision period from receipt by the Commission, with a possible extension of up to 5 days. This is different from the applicant’s 10-day period for lodging the objection.

The critical distinction is that, under Article 101 of the regulation, an objection to the Commission does not suspend the period for bringing a court action. If proceedings have also been brought before the court on the same matter, the Commission stops its examination. Waiting for the Commission’s answer must therefore not cause the court deadline running from the original rejection to be missed. (Implementing Regulation of the Law on Foreigners and International Protection, Articles 99–101)

Where is an annulment action filed, and what does it request?

A case challenging rejection of international protection falls within the administrative judiciary. Territorial jurisdiction depends on the authority that issued the decision and any applicable special rules. The general rule in Article 32 of the Administrative Judicial Procedure Law identifies the administrative court where the issuing authority is located. Living in Istanbul at the time does not mean that every decision can be challenged in Istanbul.

The petition should clearly identify the decision whose annulment is requested. Its date, reference number, notification date, the respondent administration, facts, grounds of unlawfulness and requested relief should fit together. Challenging a protection decision and challenging other measures concerning the same person may require different claims. Obtain a filing record, keep the case number and follow subsequent communications from the court.

The court reviews the lawfulness of the rejection. Annulment does not mean that the court itself always issues a protection identity document; the administration must implement the judgment. The firm’s administrative law practice page (in Turkish) concerns judicial review of administrative acts; international protection cases also require application of their specific legal provisions.

Building an evidence file that answers the reasons for rejection

Rather than simply repeating a life story, address each decisive reason in the decision separately. If the administration relied on inconsistent dates, prepare a chronology. If it suggested living in another region of the country, explain the practical possibility of travelling there safely and settling. If it considered the threat insufficiently individual, describe the events directed at the applicant. What each item proves matters more than the number of documents.

  • The rejection decision, notification record and current applicant identity document.
  • Registration and interview records, earlier petitions and previously submitted papers.
  • Threatening messages, medical reports, judicial documents and reliable news records, where available.
  • Current country of origin information with its relevance to personal risk explained.
  • Records establishing the reasons and dates where failure to report is disputed.

Make clear where documents came from, when they were created and how they relate to the case. Preserve originals while arranging necessary translations of foreign-language documents. Explain honestly why an unavailable document cannot be obtained. Fabricating papers or events to fill a gap undermines credibility. Present the information needed for examination in an organised way without disclosing unnecessary personal data.

Why do the interview, interpretation and individual circumstances matter?

A rejection may rely heavily on statements made during the interview. A short record, however, may not capture every detail the person intended to explain. Where there was misunderstanding of a question, a dialect problem, use of different calendars or an effect of trauma on memory, explain it specifically. Instead of merely saying “the translation was wrong”, identify the passage and the correct explanation.

The circumstances of children, survivors of violence and other people with special needs require individual consideration. The law requires interviews to allow applicants to express themselves, protect confidentiality and take special needs into account. Unaccompanied children’s applications cannot be assessed in the accelerated procedure. In a family application, consider whether a spouse’s or child’s distinct risks were overlooked.

In a hypothetical example, an applicant may not remember the exact date of a threat but may have submitted a treatment record from shortly afterwards. Explain how that record relates to the apparent discrepancy. In another hypothetical case, an event absent from the interview may have happened later. Separating the date of the new event from the earlier statement helps determine whether there is a real contradiction. Not every procedural defect automatically results in annulment; its effect on the decision should be shown.

Staying in Turkey and meeting obligations during proceedings

Article 80 of Law No. 6458 provides for the person to remain in the country until the objection or judicial proceedings have concluded. This safeguard reinforces the importance of using the correct remedy on time. Sending filing records to the relevant migration unit and ensuring that the ongoing proceedings are visible in the person’s file can reduce practical confusion. Do not rely only on a verbal statement that a case has been filed.

Permission to remain does not mean that every right and obligation continues unchanged. The identity document, access to healthcare, work permission and assigned province are governed by their own rules. Filing a case does not automatically grant permission to work or move to another province without authorisation. Written clarification about reporting and address obligations may be useful.

Stopping signature reporting can lead to a new administrative decision. UNHCR Türkiye likewise highlights compliance with regular reporting and monitoring the deadlines for challenging negative decisions. (UNHCR Türkiye, national international protection procedure) If illness or an unavoidable obstacle prevents compliance, keep evidence of the reason and of timely notification.

Why must removal and detention be tracked separately?

A protection rejection, a removal decision and an administrative detention decision can coexist in the same person’s file. Nevertheless, each has a different legal effect. Having a case number for the protection challenge does not mean that a separate removal order has also been challenged. Record the notification date, responsible body and filing record for each decision separately.

The separate 7-day period under Article 53 of Law No. 6458 must be considered for a removal decision. Administrative detention concerns personal liberty and is reviewed by the criminal judgeship of peace. This distinction is especially important for access to documents and communication with representatives when the person is in a removal centre. The site’s removal centre legal assistance article (in Turkish) discusses assistance in that setting.

The prohibition of refoulement and any urgent risks remain relevant across the files. Invoking that principle does not make the time limits for other notified decisions unnecessary. Release from detention does not establish that protection has been granted, just as bringing a case against the protection rejection is not itself a decision lifting detention.

Suspension of execution and explaining urgent risks

An annulment action and a request for suspension of execution are not the same. The first seeks a final review of lawfulness; the second seeks interim protection concerning implementation while proceedings continue. The general administrative law conditions require both manifest unlawfulness and harm that would be difficult or impossible to repair. The special statutory safeguard permitting an international protection applicant to remain must also be considered.

When describing urgency, specify the measure that may be implemented and why it would produce consequences that are difficult to reverse, rather than simply stating that hardship will occur. Connect any recent health problem, concrete threat or separate removal measure to the evidence. Identify the file in which the request is made; the effects of different decisions should not be merged into a single vague claim.

Where fundamental rights face a serious threat, an individual application and interim measures may be relevant subject to their own admissibility requirements. They are not a general substitute for ordinary filing deadlines. The current interim measure provision in the Constitutional Court’s Rules of Procedure must be considered together with the application conditions and the specific risk. (Constitutional Court Rules of Procedure, Article 73)

Appeal and finality after the administrative court judgment

For challenges concerning inadmissibility and accelerated procedure decisions, Article 80 contains special rules: court applications are to be concluded within 15 days and the court’s decision is final. This 15-day provision concerns the court, unlike the applicant’s filing deadline. It should not be presented as a guarantee that every case will actually finish on a particular date.

For litigation over a regular procedure rejection, available remedies are examined together with the general administrative litigation rules. Where an appeal is available, there is a 30-day period from notification of the court judgment to lodge an appeal before the regional administrative court. This new period differs from the period for filing the original action against the administrative rejection. Check the remedy information at the end of the judgment alongside its legal nature.

This judicial appeal, known as istinaf, is not an administrative objection to the Commission. Nor should a further appeal to the Council of State be assumed to exist automatically in every case. After annulment, examine the administration’s new act; after dismissal, identify the available judicial remedy; after a final judgment, assess any applicable fundamental rights application. The reasoning, not merely the operative part, determines the next step.

Lawyer support, legal aid and the applicant’s subsequent position

A lawyer can assist particularly with identifying the decision type, tracking concurrent deadlines, evaluating interview records and connecting personal risk to country information. When requesting an assessment from lawyer Esra Aslan, providing all pages of the decision and notification documents helps make the initial meeting specific to the file. The task is to identify missing information and legal options rather than promise a result.

Article 81 provides a legal aid framework for applicants unable to meet legal fees. Appointment of a lawyer by the bar association and a court request for legal aid concerning litigation expenses should be distinguished. Financial circumstances and applicable conditions are assessed; a legal aid request alone does not suspend the court deadline. Inform the relevant unit clearly of the notification date and urgency.

If the rejection becomes final, any other lawful basis for remaining must be assessed separately. A humanitarian residence permit (Turkish guide) has its own conditions and is not automatically granted after every protection rejection. Repeating the same protection application without new grounds should not be treated as a method of restarting a missed challenge period.

This article provides general information. The appropriate remedy and calculation of time limits require examination of the actual decision, notification records and individual circumstances.

Frequently Asked Questions (FAQ)

Can I go directly to court without applying to the Commission?

Yes. A regular rejection may be challenged directly before the administrative court. Applying to the Commission is not a mandatory preliminary step.

Does the 30-day period restart if I wait for the Commission?

Do not assume that the original court deadline stops or automatically restarts. The regulation expressly states that an objection to the Commission does not suspend it.

What if the decision refers to Article 72 or 79?

Have its legal nature checked immediately with the 15-day direct administrative court route in mind. A Commission objection is not provided for these decisions.

Does ten days mean ten working days?

No. The law says ten days, not ten working days. Notification and the final day must be calculated under the applicable procedural rules.

I did not understand the Turkish decision. Can I ignore the deadline?

No. Alleged inadequate information is not a safe reason to disregard the time limit. Preserve the notification papers and arrange translation and legal assessment promptly.

Can I submit new developments in my country to the court?

Yes, relevant new developments may be brought to the court’s attention under the procedural rules. Explain the date, source and connection to your personal risk.

If my application was deemed withdrawn, is describing my risk enough?

No. Address the event or alleged failure to comply that led to deemed withdrawal. Evidence of an excuse, permission or reporting is therefore important.

Does waiting for a bar association lawyer suspend the deadline?

No. Applying for legal aid alone does not stop the filing period. Send the decision and notification date to the bar and explain the urgency.

Will winning the protection case remove every other decision?

No. Other measures must be examined in their own files. Annulment of the protection decision does not make separate removal or detention proceedings unnecessary.

If the court judgment is final, are all remedies excluded?

Finality in ordinary appeals is different from a fundamental rights application. Routes such as an individual application have separate requirements and do not automatically provide a second protection assessment.
