What need does a humanitarian residence permit address?
A humanitarian residence permit is an exceptional residence permit that allows foreign nationals to remain in Türkiye because of specific humanitarian circumstances defined by law. The application must rest on more than a wish to continue living in the country: protecting a child, an inability to leave or circumstances making departure unreasonable, or another statutory ground must be relevant. Eligibility and supporting documents are assessed together in light of the particular humanitarian circumstances.
This permit is not an automatic alternative for everyone whose tourist residence application has been refused. The central questions are why the person needs to remain in Türkiye and which records explain that need. A rental agreement, a bank account or a long period of residence may not establish a humanitarian ground on their own. The legal situation should be identified before the supporting paperwork is assembled.
The principal provisions are Articles 46 and 47 of Law No. 6458 on Foreigners and International Protection. The fact that conditions for other residence categories are not applied in the same way does not mean an application is approved without examination. The law identifies the relevant circumstances, while the administration assesses the individual situation and information supplied. (Law No. 6458, Articles 46–47)
Who may have a relevant humanitarian ground?
Article 46 addresses circumstances including the best interests of a child, certain situations preventing departure, cases where removal is not ordered under Article 55, judicial challenges to specified decisions, procedures for return to a first country of asylum or a safe third country, particular urgent reasons and extraordinary circumstances. These grounds concern different situations. Relying on one does not mean that the requirements of another have also been met.
Preparing an application requires consideration of current status, previous residence permits, decisions served on the person, family relationships, health and the possibility of return. Two nationals of the same country may receive different decisions. Ongoing treatment in one case and financial hardship alone in another create different assessment grounds. Simply replacing the name in a petition downloaded from the internet can leave important facts unexplained.
For example, providing general news about conditions in a country is different from explaining through dates and records how those conditions affect the applicant personally. The general circumstances should be linked to the individual case. An unavailable document must not be presented as though it exists: the reason for its absence and any alternative records should be stated clearly.
How should the best interests of a child be explained?
A child’s best interests cannot be reduced to being present in Türkiye or enrolled at school. Care arrangements, health needs, safety, continuity of education and the possible impact of separation from family members should be explained concretely. The file should make clear the child’s age, living arrangements and the person actually providing daily care. A parent’s own wishes and the child’s needs should be described separately.
In a hypothetical case involving a parent who alone cares for a child undergoing serious medical treatment, a school certificate would not adequately explain the situation. A treatment plan, medical records showing care needs and documents explaining the other parent’s circumstances would make the case easier to understand. This example does not predict approval; it illustrates the connection between evidence and the need being asserted.
Differences in names or dates across custody orders, birth certificates and marriage or divorce records should be addressed at the outset. Where family relationships require separate legal examination, the website’s article on family law proceedings for foreigners in Türkiye (Turkish) introduces the relevant area. The residence file should contain only family records needed for its assessment.
How can health needs and inability to return be documented?
Having a medical diagnosis and being medically unfit to travel are different facts. A health-based explanation may need to address current treatment, follow-up needs and travel risks as well as the diagnosis. Applicants should rely on assessments by competent healthcare providers rather than presenting their own medical interpretation as a definitive conclusion. Whether an older report still describes the current situation should also be checked.
If departure is said to be impossible, the obstacle should be identified precisely. Difficulty obtaining travel documents, an actual interruption of transport and an ongoing procedure with the relevant authorities are distinct matters. Application dates, written responses and available records can be presented chronologically. Not wanting to travel to another country and being unable to do so do not call for the same legal assessment.
Where serious harm on return is alleged, humanitarian residence and international protection must also be distinguished. Describing a protection need merely as missing residence paperwork may obscure the central issue. Events relevant to personal safety should be explained consistently and supported where possible. Steps that could expose the person to additional danger merely to obtain documents should not be recommended automatically.
Where is the application made, and what should be asked first?
The law permits applications for humanitarian residence to be made to the governorate from within Türkiye. In practice, the file is handled through the relevant provincial migration authority, and the current local submission procedure should be established. The implementing regulation also provides for humanitarian residence procedures to be initiated at the request of the central authority or governorate. Ordinary online residence application steps should therefore not be assumed to apply identically in every case. (Implementing Regulation for the Law on Foreigners and International Protection, Article 44)
Before the first appointment or enquiry, identify the receiving unit, whether an appointment is necessary, the correct form, photograph specifications and number, translation requirements and the submission method. General information is available from the Presidency of Migration Management and YİMER 157. Such guidance does not replace a written decision or permit relating to the individual’s file. (Presidency of Migration Management, General Residence Information)
Applicants in Istanbul should likewise follow instructions from the relevant provincial unit. A location or document quantity in an old notice from another province should not be treated as the current Istanbul rule. Information obtained can be noted with its date, and the petition registration number and copies of attachments should be retained. This helps establish what was submitted and when during subsequent correspondence.
Required documents: identity records and evidence of the grounds
It is useful to divide the paperwork into two groups: records explaining identity and current status, and evidence supporting the humanitarian grounds. The following table is not an exhaustive official checklist applicable to every case. It assists preparation; current requirements specific to the applicant must also be obtained from the receiving authority.
| Document group | Possible records | Purpose |
|---|---|---|
| Identity and history | Available passport, identity document, previous residence card | Identity and status in Türkiye |
| Request and contact | Petition, requested form, photograph, address details | Reason for applying and contactability |
| Child and family | Birth, custody, care and education records | Specific needs and family relationships |
| Health | Current report, treatment and follow-up plan | Connection between health and the need to stay |
| Administrative and judicial proceedings | Decisions, service records and court records | Type and stage of each procedure |
| Obstacle to departure | Official correspondence and transport records | Why departure is impossible or unreasonable |
The humanitarian registration form published on e-İkamet can help identify the correct form type. Its availability does not establish that the entire process can be completed online, or that every field creates the same document requirement for everyone. Forms and attachments should be read alongside the authority’s instructions. (Presidency of Migration Management, Humanitarian Residence Registration Form)
Complete and verifiable records are preferable to illegible photocopies, cropped pages or undated screenshots. A large volume of documents does not itself make a strong application. It should be clear which statement each attachment supports, and information about unrelated individuals should not be included unnecessarily.
Missing passports, translations and inconsistencies
Because ordinary residence conditions are not applied in the same way, humanitarian residence should not be assessed solely against a standard short-term residence checklist. Establishing identity and presenting available records nevertheless remain important. If a passport is missing, expired or inaccessible, this should be stated honestly, with available identity records and an explanation of the problem submitted to the authority.
Translation and authentication requirements for foreign-language documents should be checked against the document type and issuing country. It cannot be assumed that every document requires an apostille or that none needs certification. Establish the accepted format before incurring expenses. Differences arising from transliteration between alphabets may require explanation, particularly across children’s records, marriage documents and passports.
If a document is still being obtained, the application can explain the stage reached. Identify the record to be supplied later, why it is unavailable and any evidence that it has been requested. Where further evidence is requested, read the deadline and delivery instructions carefully and refer to the existing file number when responding. Do not assume an unsubmitted document is already held by the authority.
How should the petition present the facts and request?
A well-prepared petition helps the reader understand the central circumstances quickly. Identity and current status can be explained first, followed by how the humanitarian need arose. Dates should be consistent, and previous applications or refusals should not be concealed. Legal terminology the applicant does not understand should not be used merely because it sounds persuasive.
For example, a hypothetical file might first describe when treatment began, then the medical assessment of travel, and finally the need to remain in Türkiye. Attachments can be numbered in the same order. This allows the decision-maker to follow the sequence of events. Lengthy unrelated narratives or generic descriptions of hardship can make the individual’s actual need harder to identify.
The request should clearly seek assessment for humanitarian residence. If there is a separate removal decision, administrative detention or another measure, any legal remedy pursued should be identified separately. Submitting a residence petition does not mean the necessary challenges to those measures have also been lodged. Proof of registration helps track these separate processes.
How should residence status be monitored while a decision is pending?
Submitting a petition and receiving a residence permit are different stages. Applicants should establish whether their document is only a receipt for paperwork or an application document with particular consequences for lawful stay. No definite conclusion about residence or travel rights should be drawn without examining the document’s title, validity and conditions.
A new medical report, court decision or change in family circumstances may arise during assessment. Such developments should be submitted with an explanation of their relevance. If an address or telephone number changes, the appropriate notification channel should be established. Where needed, a written enquiry quoting the file number can provide a better record than relying exclusively on telephone conversations.
Do not assume that a decision is guaranteed by a particular day or that silence means approval. The legal consequences of delay depend on the application and notifications involved. Where an existing permit is expiring or a separate decision has been served, merely waiting for the new application may result in loss of rights.
Permit duration, renewal and address registration
The current statutory provision refers to periods determined by the Ministry; it does not promise every applicant an automatic one-year permit. The dates in the individual decision and card should be used instead of older general explanations. Registration in the address registration system is required within twenty working days from the date the permit is issued. That starting event should not be replaced with assumptions about card delivery.
For renewal, identify current evidence that the humanitarian grounds continue rather than simply resubmitting every original document. An old treatment plan may no longer demonstrate a present need if treatment has ended. Changed care arrangements for a child should likewise be reflected. Obtain the renewal procedure from the relevant unit well before expiry becomes imminent.
If the circumstances supporting the permit cease to exist, cancellation or non-renewal may be considered. The expiry date should therefore not be understood as an unconditional right that cannot change before that date. Retain official notices and assess possible eligibility for another residence category when circumstances change.
Employment, charges and changing residence categories
A humanitarian residence card should not be treated as a document giving everyone unrestricted permission to work. A work permit or applicable exemption must be checked separately. Current arrangements include a work-permit exemption mechanism for certain humanitarian residents notified through the system by the Ministry of Interior, within the scope and period of that notification. The exemption information form and residence document must be valid together. (Ministry of Labour and Social Security, Documents Issued to Foreigners)
There are also exceptions to certain assessment criteria for work-permit applications involving humanitarian residents. An exception to criteria does not guarantee that a permit will be granted. Before beginning the process with an employer, check the correct route and whether the available records support it. (Ministry of Labour and Social Security, Work Permit Evaluation Criteria)
Humanitarian permits fall within fee legislation and should not be described as free for everyone. The document charge, permit fee and other expenses should be distinguished, and the current amount applicable to the individual should be confirmed. The implementing regulation provides that non-payment of a fee calculated for a previous residence violation does not prevent issuance where humanitarian conditions exist. This does not mean the earlier debt is automatically erased.
During the permit’s validity, a move to another residence category may be considered if its requirements are met; the special restriction concerning long-term residence must be observed. The exclusion of humanitarian residence periods from aggregation of the relevant residence periods also affects planning. The article on residence permit options (Turkish) offers general context, while current official requirements should govern the individual application.
What distinctions matter after refusal or cancellation?
Refusal of humanitarian residence, cancellation of an existing permit, non-renewal, removal and administrative detention are different measures. One notice may communicate several decisions. Read the entire document, reasons, service date and stated remedies rather than only its heading. Do not assume one petition or one deadline applies to everything in the file.
Requesting administrative reconsideration and bringing an annulment action before a court are different remedies. The effect of an administrative request on a litigation deadline depends on its legal nature. A new humanitarian residence request does not automatically restart a missed deadline for an earlier decision. The first step after receiving a refusal is therefore to identify the measure and appropriate remedy.
Legal assistance from Attorney Esra Aslan may be useful in selecting relevant evidence, explaining inconsistencies, examining service of a decision and identifying the appropriate application or remedy. The website’s administrative law services page (Turkish) also introduces judicial review of administrative measures. An assessment does not guarantee a particular result; it depends on the complete records and current circumstances.

Frequently Asked Questions (FAQ)
Can I obtain humanitarian residence after a tourist residence refusal?
A refusal alone does not create entitlement. A statutory humanitarian ground must exist in your circumstances and be explained.
Is my child’s school enrolment in Türkiye enough?
School enrolment does not ensure automatic approval. The child’s specific care, health, safety and family needs are assessed together.
Does an expired passport prevent every application?
Ordinary residence conditions do not apply identically to humanitarian residence. Explain your documents and passport situation and obtain case-specific guidance from the relevant authority.
Does one permit cover the whole family?
One person’s permit does not automatically authorise other family members to stay. Each individual’s identity, status and application arrangements must be checked.
May I start work on the day I submit the petition?
No. Submitting a petition does not authorise employment. A work permit or applicable exemption and its validity must be verified separately.
Does the application cancel a deportation decision?
An application alone does not cancel a removal decision. The available remedy and deadline must be examined separately from humanitarian residence.
How soon must I register my address after approval?
Address registration is required within twenty working days from issuance of the permit. Obtain the necessary document and registration instructions from the relevant unit.
Does paying the application charge mean approval?
No. Payment does not establish approval. Check which transaction the receipt covers and whether it has been added to the file.
Can I reuse an old medical report for renewal?
That depends on whether it still explains the current situation. New records may be needed if treatment or care requirements have changed; follow the authority’s request.
May I travel abroad while the application is pending?
Travel depends on your documents and current status. An application reference number alone should not be treated as permission to depart and re-enter.
