How does divorce affect the right to remain in Türkiye?

The effect of divorce on a foreign spouse’s residence permission depends on the type of permit and the legal basis for staying in Türkiye. If a family residence permit is based on the marriage, divorce affects that basis. It does not, however, mean that every foreign spouse is removed on the same day or loses every possible residence option. A foreign national married to a Turkish citizen who has lived in Türkiye on a family residence permit for at least three years may apply for a short-term residence permit after divorce. The three-year condition does not apply where domestic violence victimhood is established through the relevant court decision.

It is important not to wait simply because the date printed on the existing card has not expired. The finality of the divorce, the new purpose of stay, notification to the provincial migration authority and the necessary transfer application should be planned together. An independent work permit, student residence permit or another valid status may change the assessment. The first question is therefore not only how long the marriage lasted, but which permit covered each period and who acted as sponsor.

Establish whether your current permit depends on the marriage

A family residence permit is different from any residence permit held by someone who happens to be married. During a marriage, a foreign national may stay under a student permit, a short-term permit based on their own property or a valid work permit. If marriage was not the reason for granting that permission, divorce cannot be treated as a general rule automatically extinguishing all such permits. Where the spouse sponsors a family residence permit, however, the end of the marriage directly matters.

Review the current card, earlier cards, application form, decisions and any work permit together. The reason for residence may have changed over the years. Time first spent as a student and later under a family permit is not all family-permit residence. The general explanation of residence permit types and applications in Türkiye can help with this initial distinction. The records in the individual file nevertheless determine the actual position.

Filing for divorce and a final divorce are different events

Starting proceedings, moving into separate homes or hearing the judge announce a decision does not necessarily identify the date on which the marriage legally ends. For a Turkish divorce judgment, finality matters. An appeal or incomplete service of the judgment can affect that date. The Directorate General of Population and Citizenship Affairs also explains the divorce date as the date the judgment becomes final. (Population and Citizenship Affairs, Divorce Procedures)

This does not mean that nothing needs attention while litigation continues. Other family residence requirements, the intention to live together, address records and safe accommodation can be assessed separately. If the permit expires during proceedings, renewal or a move to another permit type must not be postponed. Obtaining the judgment with confirmation of finality and updating the relevant records helps establish the correct application timeline. Divorce proceedings under family law and residence procedures before migration authorities may therefore need coordinated attention.

What does the three-year condition actually require?

The special possibility in Article 34 of Law No. 6458 concerns a foreign spouse married to a Turkish citizen who has stayed on a family residence permit for at least three years. The condition is not simply three years of marriage. Even if the marriage continued abroad for many years, the period spent in Türkiye under family residence permission must be examined separately. Tourist residence, student residence and visa stays should not automatically be added to this calculation. (Law No. 6458 on Foreigners and International Protection, Article 34)

The wording allowing a permit to be granted is also important: completing three years provides an application opportunity, rather than automatic issue of a new card without assessment. Earlier permits, their start and end dates, gaps in the records and supporting documents are reviewed. If a card is missing, administrative records should be obtained rather than relying only on remembered dates. Where the qualifying period is disputed, another genuine legal basis for residence should be considered at the same time.

Must a victim of domestic violence wait three years?

No. The three-year family residence requirement does not apply to a foreign spouse whose domestic violence victimhood is established by the court decision required by law. The implementing regulation provides for submission of that decision. A person leaving because of violence therefore cannot be told that they must remain in a dangerous living arrangement solely to complete the qualifying period. (Regulation Implementing the Law on Foreigners and International Protection, Article 30)

Police records, medical reports, messages and social service records can help establish what happened. Each should not, however, be assumed to replace the statutory requirement for a court decision. The contents of any protective order, its findings and its relationship to the residence exception need separate examination. Seeking protection against violence and applying for residence are different procedures. Official information explains the available authorities and support mechanisms. (Ministry of Family and Social Services, When Exposed to Violence)

Options where the sponsor is foreign or three years are incomplete

The special rule for divorce from a Turkish citizen should not be applied unchanged to every marriage with a foreign sponsor. When a family permit depending on a foreign spouse loses its basis, eligibility for another permit type must be examined. Similarly, not completing three years does not prohibit every possible application; it means that the ordinary qualifying condition for this particular route is not met.

Genuine study, legally eligible employment or a statutory short-term residence purpose may be considered under its own requirements. Merely wishing to stay does not justify declaring a study or tourism purpose that does not exist. Humanitarian residence is not an automatic general solution to divorce and requires the exceptional statutory conditions. The requirements for humanitarian residence permission need a separate assessment. The chosen application, actual legal circumstances and living arrangements shown by the documents should be consistent.

Which situation calls for which application file?

The table shows why the same question about residence after divorce can produce different answers. These are starting points for preparing a file, not promises of approval. If more than one situation applies, the legal basis and documentary approach should be selected together.

SituationMain assessmentKey evidence
Divorce from a Turkish citizen after three years of family residenceSpecial transfer to short-term residenceFinal divorce judgment and permit history
Domestic violence established by court decisionException to the three-year conditionRelevant court decision
Less than three years or a foreign sponsorAnother genuine residence purposeDocuments supporting the selected permit
Valid work permit independent of spouseContinued validity of work authorizationPermit and employment records
Family life with a child in TürkiyeChild’s status, care and best interestsCustody, parentage and living arrangements

Owning property or having a child enrolled at school does not automatically establish every permit condition. Use the table to identify the priority questions and documents, rather than as an approval checklist. If no suitable residence basis exists after assessment, departure arrangements and remedies against existing administrative decisions must also be considered promptly.

Distinguish transfer deadlines from notification obligations

Article 26 of the implementing regulation requires a foreign national who intends to remain after the basis for their residence permit ends to apply to the relevant governorate for permission matching the new purpose within ten days of that basis ending. This is not an extra period that starts only when the printed card expires. Notification of marital status and address changes is a separate obligation. The Migration Management information booklet states that these changes must be reported within twenty working days. (Migration Management, Rights and Obligations of Foreigners in Türkiye)

It is therefore risky to delay the ten-day transfer application on the assumption that twenty working days remain for notification. Identifying the triggering event is especially important for a foreign divorce, later registration or ongoing appeal. Keep evidence of when the application was completed and distinguish the online application date from the appointment date. If a deadline has passed, do not alter dates or make an inaccurate declaration; assess the effect of the existing breach on the individual file.

Documents to prepare for the application

No single document list covers everyone. Use the list generated by e-İkamet for the application type, nationality, permit history and family circumstances. Also prepare the evidence supporting the divorce-related transfer. The authority may request additional documents, so check the current requirements again when creating the application. (Migration Management, Application Form and Supporting Document Explanations)

  • Application form, required passport or travel document pages and suitable photographs.
  • Current and previous permits and records establishing family residence periods.
  • Divorce judgment and finality details, with Turkish recognition or registration documents where necessary.
  • Evidence of the new address, accommodation, required health coverage and financial means.
  • The relevant court decision for the violence exception, and custody or parentage records where children are involved.

Difficulty obtaining a document held by the former spouse need not stop all preparation. Consider what can be obtained from court files, population records or administrative records. For foreign-language documents, check translation, notarization and any necessary apostille or consular certification. Consistent names, dates of birth and passport details help identify discrepancies that need explanation before submission.

A transfer application is created through e-İkamet, with the requested documents submitted at the appointment to the relevant provincial authority. The selected purpose must match the petition. Leaving a form unfinished or saving only an appointment screenshot does not mean every application obligation is satisfied. Retain the application number, completed form, submitted documents and residence application certificate separately. If documents are missing, check in writing what is required and by when. This preparation makes the file traceable regardless of the ultimate result. (Migration Management, Initial and Transfer Applications)

Custody and a child’s Turkish citizenship require separate assessment

Divorce does not end the legal relationship between parent and child. Being the parent of a Turkish citizen nevertheless does not automatically produce an indefinite residence permit in every case. The child’s nationality, custody, actual care arrangements, contact with the other parent and life in Türkiye should be documented. A foreign child’s own residence position also needs checking separately from the parent’s file.

The child’s best interests and family life matter to the administrative assessment. A custody judgment does not replace a residence card, and a maintenance order alone does not prove that every financial requirement is fulfilled. School, medical and care records can explain actual family life. Understanding that family proceedings involving foreigners in Türkiye and residence applications produce different legal outcomes prevents the assumption that success in one automatically resolves the other.

Foreign divorce decisions and inconsistent records

Where a foreign court or competent administrative authority issued the divorce, both finality and the procedure for its effect in Türkiye require examination. Eligible cases may use registration under Article 27/A of Law No. 5490; others may require recognition or enforcement proceedings. It is incorrect to assume that every foreign divorce requires the same lawsuit. Population authority guidance also distinguishes the foreign decision’s finality from the Turkish registration procedure. (Explanations on the Application of Population Legislation, Divorce Section)

Different marital statuses in the foreign judgment, Turkish population register and migration records can cause practical confusion. Establish in advance which record needs updating and what each authority requires. An unchanged Turkish record should not be taken to mean that all legal effects of the marriage continue. Assess the foreign decision’s effect early, particularly for application deadlines.

What to do after a residence refusal or cancellation

Obtain the written decision and evidence of service if residence is refused, cancelled or not extended. Where no special deadline applies, the general period for an administrative annulment action is sixty days, calculated from the day after written notification. If an administrative application is contemplated, calculate its effect on the court deadline separately. An ordinary request for information is not necessarily an objection that suspends time. (Administrative Judicial Procedure Law No. 2577, Articles 7, 8 and 11)

Filing a lawsuit does not automatically suspend the residence decision. Where appropriate, assess an application for a stay of execution and its requirements. A removal decision is a separate measure subject to the special seven-day court deadline in Article 53 of Law No. 6458. A residence lawsuit does not replace the necessary challenge to removal. A file review with Lawyer Esra Aslan can help distinguish service dates, identify the correct contested act and organize evidence of family life.

Two hypothetical examples of preparation

In the first hypothetical case, a foreign spouse has been married for five years, spending the first three abroad and the last two in Türkiye on a family permit. Five years of marriage does not establish three years of family residence. Other genuine residence grounds and any court-established domestic violence exception must be examined. Preparing the application solely from the marriage certificate risks overlooking the central timing issue.

In the second hypothetical case, the person divorces after four years of family residence and moves into a separate home. Alongside permit history and the final judgment, the new address, health coverage and transfer timing require attention. Eight remaining months printed on the old card do not justify ignoring the divorce. In both examples, preparation should follow the evidence; past events must not be rewritten to fit an application.

This article provides general information. The applicable procedure and deadlines require an individual assessment of permit history, notifications and family circumstances.

Frequently Asked Questions (FAQ)

Can my former spouse cancel my permit alone?

No. Your former spouse cannot make the authority’s cancellation decision, although their notification or evidence may lead to an administrative review.

Is three years of marriage enough?

No. The special route requires at least three years in Türkiye on a family residence permit; marriage duration and permit history differ.

Does an agreed divorce make residence easier to retain?

An agreed divorce does not itself create a separate residence privilege. Permit type, time and other requirements still apply.

Does leaving home because of violence end my application rights?

No. Moving to safety does not itself remove the exception; the relevant court decision and proper address notification matter.

What if my card expires while the divorce continues?

Track the permit deadline separately. Ongoing litigation does not automatically extend it; assess renewal or transfer under the existing circumstances.

Can I skip applying because my child is Turkish?

No. The parent’s residence position needs separate regulation; custody documents do not replace a permit.

Does divorce end an independent work permit?

Divorce alone does not end every work permit. Its type, basis and ongoing employment conditions should be checked.

Does applying mean a new permit has been granted?

No. Application and approval are different stages, and the rights and obligations under the application certificate require separate attention.

Is a photocopy of a foreign-language divorce judgment enough?

Usually not. Check finality, translation, certification and any Turkish recognition or registration requirements.

Can I work after suing over residence cancellation?

A residence lawsuit does not itself authorize work. A valid work permit or applicable exemption is required.
