have legal effect in Turkey

A will is not invalid merely because it was prepared outside Turkey. Its form, the testator’s capacity, the law governing succession and the steps required after death must be examined separately. Translating a foreign notarial document or obtaining an apostille does not complete all these examinations. Likewise, opening the will before a court is not a final determination that every provision is valid. (Private International Law Act No. 5718, Articles 7 and 20)

People asking this question generally fall into two groups: those preparing a will abroad for property in Turkey, and heirs who discover a foreign will after death. The first group needs coordinated arrangements across countries. The second must preserve and deliver the document and make timely applications. Identifying the correct questions avoids assuming either that foreign notarisation resolves everything or that a non-Turkish document is necessarily invalid.

Why form, capacity and substance are separate questions

Form concerns how the intention was expressed, including handwriting, signature, witnesses and execution before an authorised official. Capacity concerns whether the person was legally capable of making the disposition at that time. Substance concerns beneficiaries, the extent of their rights, reserved shares and other limits. Satisfying one category does not answer the others.

A will witnessed in accordance with foreign law may be formally valid while the testator’s capacity remains disputed. Alternatively, a valid disposition involving Turkish real estate may be subject to reduction because it infringes a reserved share. Separating these issues also identifies the evidence needed for each argument. Counting the seals on the document cannot resolve the entire succession dispute.

How the 1961 Hague Convention protects formal validity

Turkey is a party to the Convention of 5 October 1961 on the Conflicts of Laws Relating to the Form of Testamentary Dispositions. It provides alternative connecting factors supporting formal validity. These include the law of the place of execution and laws connected with the testator’s nationality, domicile or habitual residence at execution or death; for immovables, the law of their location may also apply. Each connection must satisfy the relevant timing and scope requirements. (HCCH: 1961 Convention, Article 1)

This approach helps prevent rejection solely because a will differs from familiar Turkish forms. It is not, however, a comprehensive succession code assigning every inheritance share to one country’s law. Scope, temporal application and Turkey’s reservations must be considered. Whether the country of execution is itself a party is not the only question: the Convention can refer to the law of a non-contracting state. (HCCH: Form of Wills section)

When Turkey’s reservations matter

Turkey’s reservations concern determining domicile under the law of the forum, the right to refuse recognition of oral wills made by a person possessing only Turkish nationality except in exceptional circumstances, and excluding provisions unrelated to succession from the Convention. Consequently, an oral will valid abroad is not necessarily recognised in Turkey in every situation. Oral declarations, written wills, joint wills and succession agreements should not automatically be treated as one category. (HCCH: Turkey’s reservations)

Reservations cannot be applied properly without the nationality history and nature of the document. Record the dates of dual nationality, later naturalisation and residence in different countries. A document entitled “will” does not necessarily make every provision testamentary. Instructions unrelated to post-death property transfers may require separate classification.

Which law does MÖHUK require?

Article 20 of MÖHUK generally subjects succession to the deceased’s national law, while Turkish law governs immovable property situated in Turkey. A special rule also refers the opening, acquisition and partition of inheritance to the law where the estate is situated. Testamentary form is referred to Article 7, and dispositions conforming to the deceased’s national law are also recognised as formally valid. Applicable international treaty provisions must be considered first.

Capacity is linked to the person’s national law at the time of the disposition. Asking only about nationality at death is therefore insufficient for every issue. Where foreign law applies, establishing its content is part of the case; a short explanation from a foreign notary may not resolve a contested issue. The overview of inheritance proceedings with an international element helps explain these connections. (MÖHUK, Articles 1, 2 and 20)

Turkish real estate and reserved shares

A foreign will may cover an apartment or land in Turkey, but Turkish succession rules governing that immovable property must also be considered. Broad testamentary freedom available abroad should not simply be assumed to apply unchanged to Turkish real estate. Reserved heirs’ rights, the estate and the disposable portion must be calculated under the applicable rules. Not every statutory heir has a reserved share, so describing someone merely as a relative is insufficient.

Infringing a reserved share does not necessarily make the entire will automatically void. Reduction is a distinct remedy addressing the excessive part of a disposition. A bequest of property also does not always permit an immediate name change at the land registry. The nature of the benefit, heir or legatee status and registration documents must be examined. Inheritance-law services can assist with coordinating validity, share calculations and registration. (Turkish Civil Code, Articles 505, 506 and 560)

What apostille and translation establish

An apostille simplifies authentication of the signature, official capacity and seal or stamp on a qualifying foreign public document. It is not a ruling on testamentary capacity, free consent or reserved shares. A private handwritten document and a notarial will may require different treatment. The country, document type and any exemption from authentication must be checked together. (HCCH: Apostille Convention)

Translations must accurately distinguish appointment of an heir, a specific legacy, an executor and revocation of earlier wills. A foreign legal role may not be identical to the Turkish institution with a similar name. Translating only the asset list omits other operative provisions. The original, attachments, amendments and authentications should be examined together; an accurate translation does not automatically cure an incomplete original.

Delivery and opening after a will is found

Under the Turkish delivery rule, a will discovered after death must promptly be delivered to the civil judge of peace, irrespective of whether it appears valid. A relative cannot withhold or destroy it on the basis of a personal conclusion that it is invalid. If a foreign custodian will not release the original, investigate a properly certified copy and the appropriate Turkish submission procedure without delay. Preserve records of the document’s origin and delivery.

Article 596 provides for opening and reading the will to interested parties by the civil judge of peace at the deceased’s domicile within one month of delivery. This month is not one universal deadline for heirs to bring every possible challenge. Opening communicates the contents and enables subsequent proceedings. Further wills discovered later also require the appropriate procedure. (Turkish Civil Code, Articles 595–597)

A foreign will is different from a foreign judgment

A will records the deceased’s intention. A foreign court’s decision opening a will, determining heirship or ordering performance of a right is a different legal document. Before discussing recognition or enforcement, identify which document and which effect are to be relied upon. It is incorrect to say that every foreign notarial will necessarily requires proceedings to enforce a foreign judgment.

If a foreign judicial decision exists, its nature, finality, scope and the requested Turkish outcome must be examined. Turkish immovable property, jurisdiction and public policy may matter separately. The use of a foreign inheritance certificate or judgment cannot be answered without examining the document. Using a broad phrase such as “enforcement of a will” without this distinction can confuse different procedures. (MÖHUK, Articles 50–59)

Matching the problem to the legal examination

The table shows why one foreign will may raise several separate questions. Article 559 provides a one-year period from learning of the disposition, the annulment ground and standing to sue. For wills, there are also outer periods from opening: ten years against a good-faith defendant and twenty against a defendant lacking good faith. Raising invalidity as a defence is addressed separately.

For reduction, the one-year period begins upon learning of the infringement of the reserved share, with a ten-year outer period from opening a will. Special circumstances, such as annulment reviving an earlier disposition, have a separate starting rule. Article 598’s one-month objection provision concerning issuance of a certificate to an appointed heir or legatee is different from these litigation periods. An objection in the opening file should not be assumed always to replace a separate lawsuit. (Turkish Civil Code, Articles 557–559, 571 and 598)

Reading wills made in several countries together

A person may make separate wills for assets in different countries. A major risk is a general revocation clause unintentionally affecting an earlier document more broadly than intended. A document prepared for a foreign bank account may, through its wording, conflict with an earlier will covering Turkish real estate. Different titles or languages do not remove the conflict. All dated versions, codicils and amendments should be reviewed together.

In a hypothetical example, a French will leaves all assets to one person, followed by a different disposition concerning a Turkish home. Which document covers which property, and how the later disposition affects the earlier one, depend on the complete texts and applicable law. Reading only the first page of the newer document is insufficient. Advisers in both countries should work from the same document set to avoid unintentionally undermining each other’s arrangements.

Matching people and assets to official records

A common practical difficulty is one person appearing under different names. A maiden name, transliteration from another alphabet or a name changed during naturalisation does not automatically invalidate a will, but the testator and beneficiaries must be correctly identified. Civil records and name-change certificates may establish the connection. Similar names within a family require particular care.

Property descriptions need the same attention. Old street names, changed building numbers and foreign-language addresses should be compared with current title records. Determine whether the document leaves a particular home, an inheritance share or a monetary amount. If an asset was sold before death, its continuing appearance in the will requires legal assessment; the old list should not be treated as the current estate inventory. Ownership and current title information should be verified at the outset.

This matching exercise does not permit changing the translation or inventing a new intention. Its purpose is to connect the existing wording with records. An ambiguous sentence should remain visibly ambiguous rather than be translated to suit one party. The competent authority makes the legal interpretation. Retaining the original alongside the certified translation also helps with later disputes over wording or meaning.

How heirs should prepare the file

Collect all wills and amendments, the death certificate, nationality history, domicile information, family records and details of Turkish assets. Where capacity is disputed, investigate medical records close to the date of execution. Advanced age or a diagnosis alone does not establish incapacity conclusively. Explain which date and legal issue each piece of evidence addresses, and identify the need for originals, certified copies and translations separately.

Next list pending steps: delivery and opening, notification, inheritance certificates, any necessary litigation and transfer. The sequence may differ between cases, and urgent preservation of assets or accounts requires separate consideration. A file plan with Lawyer Esra Aslan can identify missing documents, foreign-law questions and running deadlines. If representation without travelling is intended, plan the power-of-attorney process abroad early.

Someone preparing a will should also consider more than today’s asset list. Marriage, divorce, births, nationality changes or sale of significant property may justify reviewing the plan. Reliable knowledge of where the document is stored and how it will reach the competent authority after death is practically important.
